Fluidwork ("Fluidwork," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit fluidwork.co, communicate with us, or use products or services that link to this Privacy Policy (collectively, the "Services").

Depending on how you interact with Fluidwork, we may collect the following categories of information.

Information You Provide to Us

3. Customer Data and Connected Services

Certain Fluidwork Services may allow customers to provide information to Fluidwork or connect Fluidwork to third-party applications, platforms, databases, APIs, or business systems.

When we process information on behalf of a business customer, that customer may control the purposes for which the information is processed. Our processing of such information may also be governed by our agreement with that customer.

If your information was provided to Fluidwork through an organization with which you have a relationship, you may need to contact that organization directly to exercise rights concerning that information.

4. Artificial Intelligence and Automated Services

Some Fluidwork products or features may use artificial intelligence, machine learning, or automated technologies.

Information submitted to these features may be processed by Fluidwork and by third-party AI or technology providers used to provide the applicable functionality.

AI-enabled functionality may include assistance during CSV issue import previews. When this functionality is configured, Fluidwork may transmit CSV column names, up to five complete sample rows, and up to 100 distinct observed status values from the uploaded file to an AI provider to suggest field mappings and status normalization. The uploaded CSV file itself is not transmitted to the AI provider as part of this mapping step.

Customer Content is not used by Fluidwork to train artificial intelligence or machine learning models. We also require the AI providers we use to process Customer Content under terms that do not permit Customer Content to be used to train their models.

Customer Content may be transmitted to and processed by AI providers as necessary to:

• Provide requested AI-enabled functionality
• Generate responses or outputs
• Maintain and secure the Services
• Prevent fraud, abuse, or misuse
• Troubleshoot technical issues
• Fulfill customer instructions

Unless otherwise stated in an applicable customer agreement, product-specific terms, or documentation, use of an AI-enabled feature does not transfer ownership of Customer Content to Fluidwork.

5. How We Disclose Information

We may disclose information in the following circumstances.

Service Providers

We may disclose information to vendors and service providers that perform services on our behalf, including providers of:

• Cloud hosting and infrastructure
• Website security and traffic delivery
• Content delivery
• Website and product analytics
• Artificial intelligence and machine learning services
• Email and communications
• Customer relationship management
• Authentication
• Payment processing
• Security and fraud prevention
• Customer support
• Professional and technical services

These providers may process information as necessary to provide services to Fluidwork and are subject to applicable contractual and legal obligations.

Our service providers may include companies such as Clerk, OpenAI, PostHog, Resend, Railway, Google, and Cloudflare, as well as providers of S3-compatible object storage, depending on the technologies enabled within the Services. We may update the providers we use as our Services and business needs change.

Business Customers

If you use Fluidwork through an organization, information associated with your use of the Services may be accessible to administrators or authorized representatives of that organization.

Legal and Safety Reasons

We may disclose information if we reasonably believe disclosure is necessary to:

• Comply with applicable law, regulation, subpoena, court order, or other legal process
• Respond to lawful requests from governmental authorities
• Protect the rights, property, or safety of Fluidwork, our customers, users, or others
• Detect or investigate fraud, abuse, security incidents, or illegal activity
• Enforce our agreements

Business Transactions

If Fluidwork is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, information may be disclosed or transferred as part of that transaction.

We may disclose information when you direct us to do so or otherwise provide your consent.

6. Sale and Sharing of Personal Information

Fluidwork does not sell personal information for monetary consideration.

Certain privacy laws use broader definitions of "sale" or "sharing" that may include some advertising, analytics, or cross-context behavioral advertising activities.

If Fluidwork engages in activities that constitute a sale or sharing of personal information under applicable law, we will provide any notices and choices required by that law.

7. Analytics, Cookies, and Similar Technologies

Fluidwork and our service providers may use cookies, local storage, pixels, event tracking, and similar technologies to operate, secure, analyze, and improve our Services.

PostHog

We use PostHog for website and product analytics.

PostHog may help us understand how visitors and users interact with Fluidwork, including:

• Pages and features used
• Navigation patterns
• Product interaction events
• Technical performance
• Session information
• Device and browser characteristics
• Other usage information

Depending on our configuration, PostHog may process device information, browser information, usage events, session information, and network-related information.

We may configure PostHog to limit or exclude certain information from analytics collection.

Google Analytics

We may use Google Analytics to understand website traffic, usage, and performance.

If enabled, Google Analytics may collect information such as:

Because Cloudflare may act as an intermediary between your device and Fluidwork's systems, it may process technical information associated with requests to our Services, such as:

9. Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including to:

• Fulfill contractual obligations

• Maintain security

• Comply with legal obligations
• Enforce our agreements

Retention periods may vary depending on the nature of the information, the context in which it was collected, contractual requirements, and applicable law.

Deletion from our active application systems may not result in immediate deletion from every system. In particular, deleted file attachments, including attachments associated with a deleted company account, organization, or workspace, may remain for a short period in object storage, backups, logs, queues, or other residual systems while our routine deletion, lifecycle, security, and backup processes are completed. During that period, we limit our use of the attachments to those processes and do not make them available through the ordinary operation of the Services. We may retain information for a longer period where reasonably necessary to comply with law, resolve disputes, prevent fraud or abuse, or enforce our agreements.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure.

However, no method of transmitting information over the Internet or storing information electronically can be guaranteed to be completely secure.

11. Your Privacy Rights

Depending on where you live and applicable law, you may have certain rights regarding your personal information, which may include the right to:

The Services are intended for businesses and adults and are not directed to children under 13.

16. Governing Law and Venue

This Privacy Policy is governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

Unless another written agreement between you and Fluidwork provides otherwise, any dispute arising from or relating to this Privacy Policy will be brought in the applicable state or federal courts located in Wyoming.

You and Fluidwork consent to the jurisdiction and venue of those courts.
